These Terms and Conditions (''Terms'') apply to your participation in the Go with the Motability Scheme App (''The App'') Please keep these Terms in a safe place with your other Motability Scheme documents. These Terms govern the access or use by you of the App, content, products, and services (the "Services") made available by Motability Operations Limited, a company registered in England (Company Registration Number 01373876), having its offices at Level 6, 22 Bishopsgate, London, EC2N 4BQ ("MO").

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and MO. If you do not agree to these Terms, you may not access or use the Services. MO may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason. MO may amend the Terms related to the Services from time to time. Amendments will be effective upon MO's posting of such updated Terms at this location (or the amended policies or supplemental terms on the applicable Service.) Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.

You should also take the time to read the Go with the Motability Scheme Privacy Notice as it explains how we will use the data you provide us and that we collect from you.

1. Definitions

App
means the Go with the Motability Scheme App that is maintained by Motability Operations that You will download in order to access the Services

Data
means the information we collect from you including personal details such as your name, date of birth, email address and your Electric Vehicle Charging and transaction history;

Electric Vehicle ("EV") Charging Data
This includes EV charger locations that You locate via the App, may stop at to charge your Motability Scheme Vehicle as well as the data we receive from that charging session such as location of charger, date and start time and finish time of charge, duration of charge, speed of charge and cost of charge.

Go with the Motability Scheme App
means the mobile application you must download and register and which will track your charging and transaction history. It collects and transmits Charging Data which includes location of charger, duration of charging and costs of charging.

Mobile device
the device with cellular capability upon which the App will be activated;

Mobile device capability
Available on iOS and Android mobile devices only;

Motability Go Charge Card
Built and maintained by Electroverse, Once ordered and activated it allows you to start, stop and pay for a charging session via an RFID card (for more information about it, please read Electroverse's terms and conditions and privacy notice).

Technology Supplier
the company that works with us to capture the Data that the App collects and transmits Data and Electric Vehicle Charging Data to us via an API when the Go with the Motability Scheme App is switched on

We, us, our
means Motability Operations Limited;

You, your
means the Hirer as specified on the first page of the Hire Agreement;

Vehicle
means the vehicle specified on the first page of the Hire Agreement.

2. The Services

The Services constitute a technology platform that enables users of MO's App provided as part of the Services (the "App") to arrange and schedule electric vehicle ("EV") charging with independent third-party providers of such services ("Third Party Providers"). Unless otherwise agreed by MO in a separate written agreement with you, the Services are made available solely for your personal, non-commercial use. YOU ACKNOWLEDGE THAT MO DOES NOT PROVIDE ENERGY OR EV CHARGING SERVICES OR FUNCTION AS AN ENERGY PROVIDER OR EV CHARGING PROVIDER AND THAT ALL SUCH ENERGY OR EV CHARGING SERVICES ARE PROVIDED BY INDEPENDENT THIRD PARTIES WHO ARE NOT EMPLOYED BY MO OR IN ANY PARTNERSHIP WITH MO.

3. Use of the App and our Partners

3.1 Go with the Motability Scheme App has different icon applications including but not limited to Google Maps and Apple Maps with various providers for Services which are not provided directly by Go with the Motability Scheme but our partners (please refer to the Go with the Motability Scheme Privacy Policy and Motability Scheme Customer Privacy Notice https://www.motability.co.uk/utilities/privacy-notice for further information).

You acknowledge that portions of the Services may be made available under the MO brand. You also acknowledge that the Services may be made available under the brands of: (i) the Motability Scheme; (ii) MO affiliates; or (iii) independent Third Party Providers, including energy providers, EV Charging providers, EV Charging aggregators, payment providers or holders of similar energy, EV Charging and payment provider permits, authorisations or licenses.

4. Go with the Motability Scheme App and its use

4.1 In order to use most aspects of the Services on the App, You will need to follow the instructions provided to register your account on the Go with the Motability Scheme App. Registration requires you to submit to MO certain personal Data such as your name, address, mobile number and email. You must agree to maintain accurate and complete up to date information in your account, You are responsible for all activity that occurs under your account in the App, and you agree to keep your username and password confidential. Unless otherwise permitted by MO in writing, you may only possess one account.

4.2 You must ensure that you enable the location services on your mobile device and configure your mobile device settings as per the instructions provided upon registration of the Go with the Motability Scheme App.

4.3 Once the Go with the Motability Scheme App has been activated it will record and analyse your EV charging behaviour. It is your responsibility to ensure that the Go with the Motability Scheme App is switched on while you are driving.

4.4 You will be able to locate EV chargers, start and stop charging as well as pay for your charge all via the App.

5. Paying for Charging

5.1 You understand that your use of the Services may result in chargers to you for the Services. Payments are processed and taken by our Third Party Partner, Adyen, who manage all payments using Your banking details which are given directly to them via the App. No banking details are shared by Ayden with MO. You will need to add your own payment card (Amex, Mastercard or Visa) onto the app and thereafter You will be able to place an order for a RFID Motability Go Charge card via the App and this will be sent to you.

All Charges are due immediately and payment will be facilitated by MO using the preferred payment method designated in your Account, after which, a downloadable or emailable receipt will be available in the Go with the Motability Scheme application. Should your payment for the Services fail, MO will email you with a payment link to make payment for the Services. Failure to make payment will result in a denial of future access to the Go with the Motability Scheme application.

5.2 Please take note that Charges may include other applicable fees, for example some locations may charge an overstay fee where you stay for a number of hours after your vehicle has finished charging and will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by MO

5.3 If you do not pay for your charging session or have enough credit loaded onto the Motability Go Charge card, You will be blocked from charging your EV in the future unless you pay for the previous charging session within 28 days.

5.4 MO reserves the right to establish, remove and/or revise Charges for any or all Services obtained through the use of the Services at any time in MO's sole discretion. Further, you acknowledge and agree that Charges for different types of Services and from different Third Party Providers may vary in price in certain geographical areas (such as fast chargers in motorway service stations). You will be responsible for Charges incurred under your account regardless of your awareness of such Charges or the amounts thereof.

6. Charging Data

6.1 Charging Data will be generated for each charging session using a proprietary algorithm owned by our Technology Supplier and shared with us.

6.2 The Data is broken down into sub-scores in respect of charging sessions ie. charge detail records which includes speed and duration of charging and location of charger and usage as well as the cost of the charging session.

7. License

Subject to your compliance with these Terms, MO grants you a limited, non-exclusive, non- sublicensable, revocable, non-transferrable license to: (i) access and use the Application on your own device solely in connection with your use of the Services; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by MO.

8. Restrictions

You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by MO; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorised access to or impair any aspect of the Services or its related systems or networks.

9. Third Party Services and Content

The Services may be made available or accessed in connection with third party services and content (including advertising) that MO does not control. You acknowledge that different terms of use and privacy policies may apply to your use of such third party services and content. MO does not endorse such third party services and content and in no event shall MO be responsible or liable for any products or services of such third party providers. Additionally, Apple Inc., or Google, Inc., and/or their applicable subsidiaries and affiliates will be third-party beneficiaries to this contract if you access the Services using Applications developed for Apple iOS or Android mobile devices, respectively. These third party beneficiaries are not parties to this contract and are not responsible for the provision or support of the Services in any manner. Your access to the Services using these devices is subject to terms set forth in the applicable third party beneficiary's terms of service.

10. Ownership

The Services and all rights therein are and shall remain MO's property. Neither these Terms nor your use of the Services convey or grant to you any rights in or related to the Services except for the limited license granted above.

11. Operating System Requirements

Go with the Motability Scheme App requires an Android and/or Apple operating system. You will be able to download Go with the Motability Scheme App in your mobile phone or tablet from Google Play store and/or Apple Store.

12. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." MO DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, NOT EXPRESSLY SET OUT IN THESE TERMS, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, MO MAKES NO REPRESENTATION, WARRANTY, OR GUARANTEE REGARDING THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY OR AVAILABILITY OF THE SERVICES OR ANY SERVICES OR GOODS REQUESTED THROUGH THE USE OF THE SERVICES, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. MO DOES NOT GUARANTEE THE QUALITY, SUITABILITY, SAFETY OR ABILITY OF THIRD PARTY PROVIDERS. YOU AGREE THAT THE ENTIRE RISK ARISING OUT OF YOUR USE OF THE SERVICES, AND ANY SERVICE REQUESTED IN CONNECTION THEREWITH, REMAINS SOLELY WITH YOU, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

13. Limitation of Liability

MO shall not be liable for any indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, loss of data, personal injury or property damage related to, in connection or otherwise resulting from any use of the Services, even if MO has been advised of the possibility of such damages. MO shall not be liable for any damages, liability or losses arising out of: (i) Your use of or reliance on the Services or your inability to access to use the Services; or (ii) Any transaction or relationship between you and any third party provider, even if MO has been advised of the possibility of such damages. MO shall not be liable for delay or failure in performance resulting from causes beyond MO's reasonable control. In no event shall MO's total liability to you in connection with the Services for all damages, losses and causes of action exceed five hundred Pounds (£500)

MO's Service may be used by you to locate, request, schedule, use or pay for Services with Third Party Providers, but you agree that MO has no responsibility or liability to you related to any Services provided to you by Third Party Providers other than those expressly set forth in these Terms.

15. Changes to these Terms and Conditions

We reserve the right, at our sole discretion, to change, modify, add or remove all or portions of these Terms and Conditions and the Services at any time It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the Go with the Motability Scheme App following the changes will mean that you accept and agree to the changes.

16. Updates to Go with the Motability Scheme

From time to time, we may automatically update the App to improve performance, enhance functionality, reflect changes to the operating system or address security issues, alternatively we may ask You to update the App for those reasons. We may send updates or new features, if you choose not to install such updates or if you opt out of automatic updates, you may not be able to continue using Go with the Motability Scheme App.

17. Communication

As part of your participation in Go with the Motability Scheme, you may be asked for feedback by email or SMS, in order for us to improve our App and App features which in turn help to improve your driving and charging experience.
